Privacy policy.

In short: no analytics, no advertising, everything on our own server in Germany. Here are the details. The German version is legally binding.

The key points first

This website does not use any analytics or advertising services. Fonts, scripts, images and videos are hosted on our own server. The only exception is the Google reCAPTCHA spam protection on the contact page. It is only loaded if you have agreed to it in our cookie dialog and fill in the form.

Hosting and server logs

The website is hosted on a server in Germany that we manage ourselves. The data centre is operated by IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany, with whom we have a data processing agreement pursuant to Art. 28 GDPR.

With every visit, the web server stores technically necessary information in log files: IP address, date and time, the address requested, the amount of data transferred, status code, referring page, and browser and operating system. This serves the secure and stable operation of the website, for example defending against attacks. The legal basis is our legitimate interest pursuant to Art. 6 (1) (f) GDPR. The logs are rotated weekly and deleted after five weeks at the latest, unless they are needed to investigate a security incident.

Cookies and consent

We do not set any cookies ourselves. We store your choice in the cookie dialog in your browser's local storage (entry “funck-einwilligung”) so that the dialog does not appear on every visit. This entry contains only your choice and the time, never leaves your device and is permitted without consent under Section 25 (2) No. 2 TDDDG. We ask again after twelve months.

We only load the reCAPTCHA spam protection with your consent pursuant to Section 25 (1) TDDDG and Art. 6 (1) (a) GDPR. You can change or withdraw your choice at any time via the cookie at the bottom left or here:

Contact by email, phone or WhatsApp

When you write to us or call us, we process your details to handle your request. The legal basis is Art. 6 (1) (b) GDPR if it concerns a contract or an enquiry about one, otherwise Art. 6 (1) (f) GDPR. We delete the details as soon as the matter has been dealt with and no statutory retention periods apply.

The WhatsApp button is a simple link. Only when you click it does WhatsApp open, a service of WhatsApp Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland (part of Meta). If you write to us there, WhatsApp processes your phone number, your messages and metadata under its own terms, including in the USA. WhatsApp is certified under the EU-US Data Privacy Framework. We only use your message to reply to you. If you do not want this, please use phone, email or the contact form. More information: WhatsApp privacy policy.

Contact form

When you write to us via the contact form, you send us the details you enter there: first and last name, email address, optionally company and phone number, the selected areas and your message. We send these details by email to our mailbox kontakt@funck.gmbh and use them solely to answer your enquiry. The legal basis is Art. 6 (1) (b) GDPR if it concerns a contract or an enquiry about one, otherwise Art. 6 (1) (f) GDPR.

To prevent misuse, the server stores an irreversible hash of your IP address to block too many requests in a short time. This value is deleted after 24 hours at the latest. We delete your enquiry as soon as it has been dealt with and no statutory retention periods apply.

Spam protection with Google reCAPTCHA

To prevent the contact form from being misused by automated programs, we may use Google reCAPTCHA v3, a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. reCAPTCHA is only loaded if you have agreed to “Spam protection” in the cookie dialog, and only once you click into the form. Without consent, the form still works, and we protect it with our own means.

When loading and submitting, reCAPTCHA evaluates information such as your IP address, browser and device information, time spent on the page and mouse movements, and may set cookies. From this, Google calculates a score indicating how likely it is that you are a human. We only receive this score. Data may be transferred to the USA in the process. Google is certified under the EU-US Data Privacy Framework. The legal basis is your consent pursuant to Art. 6 (1) (a) GDPR and Section 25 (1) TDDDG, which you can withdraw at any time. Your rights

You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), objection to processing based on legitimate interests (Art. 21) and withdrawal of consent with effect for the future (Art. 7 (3)).
